COLDEN COMMON CRICKET CLUB

CONSTITUTION

FORMALLY ADOPTED AND AMENDED AT CLUB AGM

GENERAL

1. The club shall be known as the Colden Common Cricket Club (CCCC). The club will be affiliated to the ECB via the Hampshire Cricket Board.

2. The object of the club is to provide facilities for cricket and good fellowship amongst its members. CCCC will ensure that it has a full duty of care to all of its members by adopting and implementing the current and updated ECB ‘Safe Hands’ policy and the current and updated ECB Equity Policy Statement. The club will offer training and playing facilities and will promote itself within our community and wider.

3. All members are encouraged to play a full part in the life of our club through playing, coaching, social and fundraising activities.

4. The club will have a President, a number of Vice-Presidents and officers and three categories of members, Full Members, Junior Members and Life Members.

5. The officers of the club, to be elected at each Annual General Meeting (AGM) will be the Chairman, Secretary, Treasurer and Social Secretary. In addition the First and Second Team captains, as elected at the AGM, will also serve as officers of the club. This will be the club’s General Committee.

6. At any club meeting the Chairman will take the chair.

7. Vice-Presidents and Life Members will be elected by the General Committee taking account of recommendations by members.

GOVERNING THE CLUB

1. Management of CCCC will be vested in the General Committee which will delegate particular tasks to members from time to time.

2. At the AGM all members of the General Committee will retire but will be eligible for re-election. Nominations should be received by the Secretary prior to the AGM and all nominees must be members of the club and be willing to stand for office. Election will be by secret ballot and every member present will be eligible to vote. To be elected, any candidate must be either unopposed or receive a simple majority of the votes cast. In the event of a tie, the Chairman’s vote will be the casting vote. If the vote for the Chairman is tied, the President will have the casting vote.

3. The AGM will be held each year as soon as possible after the end of the playing season and in every year before December 1st.

4. The General Committee will have the power to invite members to fill any post for which no nominations have been received at the AGM or to fill any office which becomes vacant during the year.

5. At the AGM any resolution or business raised by any club member will be discussed. The AGM will also receive reports on the previous season from the team captains.

6. No rule or regulation of the constitution will be altered, rescinded or added to without a two thirds majority of members present at any AGM or Extraordinary General Meeting (EGM) being in favour of any such change.

7. An Extraordinary General Meeting may be called at any time by the General Committee. Additionally, any three Full Members acting together on an issue may request to the General Committee that an EGM be called.

8. At any AGM or EGM all full members present will be entitled to one vote. In the event of a tied vote, the Chairman will have a deciding or casting vote. Voting will be by a show of hands unless the Chairman decides that a secret ballot is preferable.

9. The General Committee will meet regularly throughout the year as required and communicate outcomes to the membership. At all General Committee meetings all votes will be by a show of hands unless the Chairman decides that a secret ballot is preferable. In the event of a tied vote the Chairman will have a deciding or casting vote.

10. The Treasurer will receive all match fees, subscriptions donations and other monies paid to the club and shall disburse payments subject to the scrutiny and control of the General Committee. He/she will keep the accounts of CCCC and present to the AGM an audited balance sheet and statement of accounts. The Treasurer will also provide a general forecast of the club’s financial position taking into account any upcoming expenditures. The club’s financial Year will end on September 1st and all club accounts will be balanced to that date.

11. The Secretary will be responsible for recording the minutes of the AGM and all General Committee meetings. He/she shall give notice of all AGM and other General Meetings of the club.

MEMBERSHIP

1. Membership of CCCC will be open to all, regardless of gender, age, disability, race, ethnic origin, creed, colour, social status or sexual orientation. However, limitation of membership due to limitation of facilities is allowable on a non-discriminatory basis. All members of CCCC have a responsibility to oppose discriminatory behaviour of any sort and to promote equal opportunity. The General Committee may refuse membership, warn members as to their future behaviour, suspend members and expel from membership only for good and sufficient cause, taking into account the club’s Code of Conduct at Appendix 1.

2. Any member so warned, suspended or expelled by decision of the General Committee will have the right of appeal. The appeal board will be chaired by the Club President or other person acceptable to both the the appellant and the General Committee. The appeal board will comprise at least two other persons, neither of which will have been involved in the original alleged offence or be members of the General Committee. The appellant will have the right to attend any appeal hearing, to speak and to be accompanied by a friend or representative. The appeal board will have power either to confirm or overturn the sanction imposed by the General Committee. The appeal board’s decision will be transmitted to all parties within one week and will be binding on all parties.

3. Full Members will be at least eighteen years of age or in full time education on May 1st in each season. Those under eighteen or in full time education will be known as Junior Members and entitled to a reduced annual subscription and match fees. Full Members not in paid employment will also be entitled to a reduced annual subscription and match fee. The General Committee may also after due consideration reduce or waive annual subscriptions or match fees for any member in exceptional circumstances. Any person resigning from the club after paying the annual subscription will not be entitled to any refund. Players joining the club in the course of the season will pay a reduced annual subscription agreed between the player and the committee.

4. All members shall be subject to the terms and regulations of this constitution and Code of Conduct.

SUBSCRIPTIONS

1. Annual subscription and match fee will be decided at each AGM as will any discount for early payment. Due dates for payment will also be agreed at each AGM.

DISSOLUTION

1. If at any General Meeting (AGM or EGM), a resolution is passed calling for the dissolution of CCCC, the Secretary will immediately convene a Special General Meeting (SGM) to be held within one calendar month. If at that SGM the resolution to dissolve is carried by a two thirds majority of those members present the General Committee will, at a date set at the SGM, proceed to realise the assets of the club and to discharge all debts and liabilities. If, when that is done, any assets remaining shall be transferred to an agreed sporting or charitable organisation.

Appendix One
Code of Conduct

All Members and Guests of Colden Common Cricket Club Shall:

• Respect the rights, dignity and worth of every person within the context of cricket

• Treat everyone equally and not discriminate on the grounds of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs

• Not condone, nor allow to go unchallenged, any form of discrimination, if witnessed

• Play cricket in the true spirit of the game. In particular, Captains are reminded of their responsibility under Law One of the Laws of Cricket to ‘ensure that play is conducted within the spirit of the game as well as within its laws.’

• Display high standards of behaviour

• Report all breaches of this Code of Conduct to the club Committee

All Players Shall:

• Arrive at the ground or designated meeting point, at or before the agreed meeting time and in a fit state to play

• Respect the opposition and officials

• Not question any decision made by the umpires either by word or action

• Not engage in any action which is deemed to be unfair under Law 42 of the Laws of Cricket: ‘Fair and Unfair Play’. This includes ball tampering, distracting or obstructing the opposition, dangerous or unfair bowling, time wasting, damaging the pitch and breaching the spirit of the game. These actions by any player shall constitute a breach of this Code of Conduct whether or not they are observed and/or dealt with by the umpire.

• Not allow poor behaviour by the opposition to affect their own conduct

• Not engage in any social media or other activity which criticises the club, individual members or officers, umpires and other officials, other teams or the Hampshire Cricket League.

All Full Members of the Club, when engaging in any Cricket Activity with Junior Members or Minors, Shall:

• Not be drunk, nor drink to excess

• Not allow or encourage Junior Members or minors to drink or smoke

• Not engage in any form of adult conversation or behaviour

• Place the wellbeing, security and safety of these young players above all other considerations

• Respect the opinions of young players

• Ensure that ECB guidance for particular age groups is known and adhered to. This applies particularly to Team Captains.

All Junior Members Shall:

• Abide by the same Code of Conduct as Full Members

• Abide by instructions given by the Team Captain

• Not put themselves in situations or positions in the match where they do not feel safe, and report immediately to the Team Captain or other senior player if they are instructed to do so.

• Know the ECB safety guidance which applies to their age group, and abide by it
