CONSTITUTION

BROADSTAIRS CRICKET CLUB

1. Name
The Club shall be known as Broadstairs Cricket Club.
2. Aims and Objectives
The aims and objectives of the Club will be:
•To foster and promote the sport of Cricket at all levels within the community and within the sport, providing opportunities for recreation, coaching and competition.
•To manage Broadstairs Cricket Club.
•To ensure that all members, playing and non-playing, abide by the ECB Codes of Conduct which incorporates the Spirit of Cricket and by the Laws of Cricket.
•To ensure a duty of care to all members of the Club by adopting and implementing the ECB ‘Safe Hands – Crickets Policy for Safeguarding Children’ and any future version of the policy.
•To ensure a duty of care to all members of the club by adopting and implementing the ECB Cricket Policy and any future versions of the policy.
•To encourage all members to participate fully in the activities of the club.
3. Membership
•Membership should consist of officers and members of the Club;
•All members will be subject to the regulations of the constitution and by joining the Club will be deemed to accept these regulations and Codes of Conduct that the Club has adopted;
•Members will be enrolled in one of the following categories:

•Full member
•Associate member
•Junior member
• life member
Membership, both playing and social, is open to all members of the community and is without discrimination on the grounds of ethnicity, nationality, sexual orientation, religious beliefs, sex, age or disability, except as a necessary consequence of the requirements of playing cricket.
4. Membership fees
•Membership fees will be set annually and agreed by the Management Committee or determined at the Annual General Meeting;
•Fees will be paid by weekly subscription.
5. Officers of the Club
The Officers of the Club will be: Chair
•Vice Chair
•Honorary Secretary
•Treasurer
•Fixtures Secretary
•Wine Secretary
•Groundsman
•Chairman of Selectors
•Clubmark Development
Officers will be elected annually at the Annual General Meeting.
All Officers will retire each year but will be eligible for re-election.
6. Committee
The business of the club will be managed through a anagement Committee, elected at the Annual General Meeting.
In addition to the powers of authority of this Constitution, the Management Committee may exercise all powers and authority and undertake all acts in the furtherance of aims for which Broadstairs Cricket Club is established and are not hereby expressly directed.

The Management Committee will be responsible for adopting new policy, codes of conduct and rules that affect the organisation of the Club.
The Management Committee will have powers to appoint sub-committees as necessary and appoint advisers to the Management Committee as necessary to fulfil its business.
The Management Committee will be responsible for disciplinary hearings of members who infringe the Club ruleslregulations/constitution. The Management Committee will be responsible for taking any action of suspension or discipline following such hearings.
The Management Committee shall appoint a Social Sub-committee at the first meeting following the Annual General Meeting. Primarily, but not exclusively, the social sub-committee shall incorporate the roles, duties and responsibilities of a Wine Committee and shall have charge of and responsibility for the Club Premises. It shall purchase wines, spirits and beers and shall be responsible to the Management Committee for the conduct and management of the clubhouse and all purchases and sales on the Club's premises. This committee shall also be responsible for the application to all members and guests of the relevant sections of the Licensing Acts 1961 and 2004.
Such other committees or sub-committees shall be established as deemed appropriate by the Management Committee or by vote at the Annual General Meeting (Special General Meeting). The terms of reference of such committees shall be determined by the Management Committee.
7. Co-option
Power to co-opt as deemed appropriate shall be vested in all committees of the Club but such co-opted committee members shall not be entitled to vote. Co-opted members may be non Club members invited to advise on specialist subjects.
8. Voting
At all meetings of the Club, including Annual and Special General Meetings, each eligible member, having attained the age of 18 years, shall be entitled to 'one vote. In the event of an equal vote the Chairman of the meeting shall have a second or casting vote. An eligible member is he or she who has paid in full his/her annual subscription to the Club by 31 May of the relevant year.

9 . General Meetings
The Annual General Meeting of the Club shall be held following the end of the season and by the 13 December at the latest.
Notice of the Annual General Meeting (AGM) of the Club will be given by the Club Secretary. Not less than 21 days clear notice to be given to all members in writing, accompanied by the Agenda and Papers signifying the business to be transacted which shall include:
•Confirmation of the Minutes of previous AGM and matters arising
there from.
•Annual Report (Chairman)
•Statement of Accounts and Treasurer's Report
•Youth Cricket (Development Officer - Youth Cricket)
•Election of Officers
•Notified amendments to the Constitution
•Annual Subscriptions
•Other business duly notified to the Secretary
•Business from the floor (at Chairman's discretion)
Nominations for officers of the Management Committee will be sent to the Secretary prior to the AGM.
The quorum for AGM's/EGM's will be 10 members. The quorum at Management and other Committees shall be a fraction/number of the membership of that Committee.
10. Child Protection Policy
The Club Welfare Officer will exercise due diligence in ensuring that the Club adopts the guidelines and rules for the protection and welfare of young people as set forth in:
a)ECB 'Safe Hands - Welfare of Young People in Cricket'
b)NSPCC Time to Listen - Safeguarding and Protecting Children in Sport
11 Secretary

The secretary shall be responsible for all correspondence including the Notice, Agenda and Minutes of Annual , Special and Management committee meetings. Minutes of the aforementioned meetings shall be presented for confirmation at the following meeting. (Each other established committee shall appoint a secretary who shall record the minutes of those meetings.)
12 Finance
All Club monies will be banked in an account held in the name of the Club.
The Club Treasurer shall be responsible for all financial matters of the Club including receipt of monies, payments, banking and the production of an Annual Balance Sheet/Statement of Accounts and Annual Report.
The Treasurer shall also be responsible for an update of the financial position as required by the Management Committee which, in normal circumstances, shall be at the monthly Management Committee Meeting.
An audited statement of annual accounts will be presented by the Treasurer at the Annual General Meeting.
Any cheques drawn against Club funds should hold the signatures of the Treasurer plus Chairman and Secretary.
The financial year of the Club will end on 31 December.
13 Auditor
An Auditor for the ensuing year shall be appointed at the Annual General Meeting and shall not be a member of any Committee of the Club.
14 Subscriptions
A bona fide member of the Club shall be deemed as such upon payment of the appropriate subscriptions by the stipulated date each year or by Management Committee recorded decision. A list of members in all categories which includes current address shall be maintained by the Treasurer and notified to the Secretary.
15 Monies
Any member authorised to collect monies for or on behalf of the Club shall pay such monies to the Treasurer within seven days of such collection or within seven days following a specific event.

16 Eligibility
No person shall be eligible to take part in the business of the Club unless the appropriate subscription has been paid by the specified date, or membership agreed by the management Committee.
No person shall be eligible for selection for any Club team unless his/her subscription has been paid by the specific date.
The Treasurer shall inform the Management Committee meetings following the specified dates of those who have paid subscriptions and those who are in default.
17 Discipline and appeals
All complaints regarding the behaviour of members should be submitted in writing to the Secretary.
The Management Committee will meet to hear complaints within 7 days of a complaint being lodged. The committee has the power to take appropriate disciplinary action including the termination of membership.
The outcome of a disciplinary hearing should be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within 7 days of the hearing.
There will be the right of appeal to the Appeal Board following disciplinary action being announced. Any member attending an appeal hearing has the right to be represented and produce witnesses in support of his/her appeal.
The Appeal Board (a maximum of three) shall not include members of the Management Committee but may include non-members of the Club. The Appeal Board should consider the appeal within 14 days of the Secretary receiving the appeal.
The decision of the Appeal Board shall be final and binding on all parties.
18 Suspension
The Management Committee shall h~ve the power to suspend or exclude any member in any category for contravention of this Constitution and or documented rules and/or Codes of Conduct.

21Junior Committee

19 Dissolution
A resolution to dissolve the club can only be passed at an AGM or EGM through a majority vote of the membership.
In the event of dissolution of Broadstairs Cricket Club, or its winding up, the Management Committee shall:
•Ensure the discharge of all outstanding liabilities and debts so far as the finances of the Club permit;
•Ensure that remaining funds and assets be distributed to assist and promote the development and playing of cricket in Broadstairs and its locality, provided that the recipient be registered as a Community Amateur Sports Club or a Registered Charity or the English Cricket Board, due regard being given to the advice of the Thanet branch of the Kent Cricket Board ..

20 Amendments to the Constitution

The Constitution will only be amended through Agreement by majority vote at an Annual or Extraordinary General Meeting with the specified notice in writing of the meeting, together with the proposed amendment(s).

Broadstairs Cricket Club hereby adopts and accepts this constitution as a current opera in guide regulating the actions of members.

Although the club wants the best players to come through and play for the club, a balance must be struck between those and the lesser player who attends training regularly and shows a commitment to the club. The coaches decision needs to be objective and able to stand up to scrutiny from parents of players who felt they had been treated unjustly. Coaches are there to resolve conflict rather than cause problems. If you trained regularly and were competent, the player should expect the opportunity to take a full part in the games played albeit on a squad rotational basis.
